FACTS ABOUT WAGE THEFT

Wage theft is when a boss doesn’t pay his workers what they are owed.   Sometimes that means paying less than minimum wage, not paying overtime, not allowing meal or rest breaks, keeping the workers tips, paying them in cash, or not paying for all hours worked.
Oftentimes, wage theft affects the most vulnerable workers, those who are desperate for pay, who are undocumented, or are willing to get paid only in cash.  This practice allows the boss to cut costs and make more money.  Also, the bosses avoid paying taxes.

Wage Theft is illegal in New York.

Specifically, workers are protected by both Federal and New York State Law that prevents a Boss from doing the following:

  • Pay some less than 1.5 times a worker’s hourly rate for those hours worked over 40 hours in a work week.
  • Pay for all hours worked in a week.
  • Pay a worker cash for a workweek without regard for overtime hours worked.
  • Give a worker a notice of pay when that worker is hired.
  • Have a precise accounting of all hours a worker worked in a week.

Who is entitled to overtime?

With few exceptions, all workers are entitled to overtime pay for hours worked over 40 in a workweek. These workers include:

    • Carpenters,
    • Construction Workers,
    • Electricians,
    • Laborers,
    • Maintenance,
    • Bus boys,
    • Waiters,
    • Painters,
    • Plumbers,
    • Landscapers and
    • Tree Cutters.

  • What about Salaried Employees?

    You too must be paid overtime unless you are part of certain narrow exemptions. Do not let your boss wrongly claim that you cannot get overtime because you are paid a weekly rate or are salaried.

  • How long do I have to sue my Boss?

    If your Boss acted intentionally (willfully), then you can recover up to three years of stolen wages in Federal Court, or 6 years in New York State Court.

  • How much can I get paid?

    You are entitled to all of  your owed wages that weren’t paid to you, plus double damages, interest, and attorneys’ fees.

  • How do the Attorneys get paid?

    We don’t charge hourly fees to our clients. We don’t have a consultation or retainer fee. We only get paid if our clients get paid, and that payment comes directly from the employer. If your case is settled, then M&F will typically receive a portion of any settlement. If the case is won at trial, M&F will ask the Court to grant a separate award for attorneys’ fees. Either way, you pay no attorneys fees.

  • What do I do?
